Case Assignment 6.1

Has Marty Pendall breached his duties as an agent?

An agent must act in the best interests their principal. This includes;

-       fully disclosing any conflicts of interest

-       not accepting secret commissions

Marty has breached the above duties, by pursuing his own deal rather than properly representing the Eustons. If Marty makes $100,000 (by selling the property to the developer for $400,000) it would be a secret commission.
